An Illinois trial court recently declared that caps on non-economic damages in medical malpractice cases imposed by the Illinois Legislature are unconstitutional. Cook County Judge Diane Joan Larsen found that caps on non-economic pain and suffering damages in medical negligence cases violate a plaintiff’s rights.
